These Terms & Conditions (“Terms”) govern your use of SkullsTees.com and purchases of products or services from Skulls Tees & Clothing Company (“Skulls Tees,” “we,” “us,” or “our”), a business operated by Twisted Palms Ventures, Inc.
By accessing our website, placing an order, approving a custom project, or purchasing products or services from Skulls Tees, you agree to these Terms.
Custom Apparel Orders
Custom apparel is produced according to specifications approved by the customer.
Customers are responsible for reviewing all project details before approving production, including:
- Artwork
- Spelling
- Names and wording
- Logos
- Garment type
- Garment color
- Garment sizes
- Quantities
- Artwork placement
- Approximate artwork size
- Print colors
- Other project specifications
Production may begin after approval and any required payment or deposit has been received.
Artwork Approval
When Skulls Tees provides an artwork proof, mockup, approval document, or similar representation, the customer is responsible for carefully reviewing it before approval.
Approval may be provided electronically, including through an electronic signature, approval form, email, or other documented electronic communication accepted by Skulls Tees.
Customer approval constitutes authorization to produce the order according to the approved specifications.
Once approved, errors or characteristics visible in the approved proof, including spelling, artwork selection, placement, sizing, or other approved specifications, generally will not constitute a production defect.
Changes requested after approval may result in additional charges, production delays, or the need to restart portions of production.
Digital Mockups and Finished Products
Digital proofs and mockups are intended to provide a reasonable representation of the finished product.
Screens display colors differently, and actual printed colors may vary from colors displayed on a monitor, phone, tablet, or other electronic device.
Artwork dimensions and placement shown in mockups may also appear somewhat different when applied to garments of different sizes.
Reasonable variations between an approved digital mockup and the physical product do not necessarily constitute a defect.
Garment and Manufacturing Variations
Apparel products are manufactured by third parties.
Minor variations may occur between garments, production batches, colors, measurements, stitching, fabric characteristics, and sizing.
Manufacturer sizing specifications are approximate. Customers are responsible for selecting appropriate sizes based on available manufacturer sizing information.
Skulls Tees is not responsible for normal manufacturer tolerances or reasonable differences between garment batches.
Print Placement and Production Tolerances
Apparel decoration is a physical production process.
Minor variations in artwork position, alignment, dimensions, or appearance may occur between individual garments.
Reasonable production tolerances that do not materially affect the overall appearance or intended use of the product will not be considered defects.
Customer-Supplied Artwork
Customers are responsible for artwork, logos, trademarks, photographs, text, and other materials they provide to Skulls Tees.
By providing materials for reproduction, you represent that you own the materials or have permission and legal authority to reproduce and use them.
You authorize Skulls Tees to reproduce, modify, resize, prepare, and otherwise process the materials as reasonably necessary to fulfill your order.
Skulls Tees is not responsible for determining ownership or licensing rights for customer-supplied materials.
You agree to be responsible for claims arising from materials you provide when you did not have sufficient rights or authorization to use them.
Skulls Tees reserves the right to refuse any project that we reasonably believe may violate intellectual-property rights, applicable law, or our business policies.
Artwork Created by Skulls Tees
Unless otherwise agreed in writing, original artwork, concepts, layouts, production files, templates, and design elements created by Skulls Tees remain the intellectual property of Skulls Tees or Twisted Palms Ventures, Inc.
Purchase of decorated apparel does not automatically transfer ownership of underlying design files, source files, production files, or intellectual-property rights.
Any transfer or licensing of such rights must be separately agreed to in writing.
Customer-owned logos, trademarks, and artwork remain the property of their respective owners.
Portfolio and Promotional Use
Unless confidentiality or other restrictions have been agreed upon in writing, Skulls Tees may photograph completed products and use images of work we have produced for portfolio, website, social-media, sales, or promotional purposes.
This does not transfer ownership of a customer’s trademarks, logos, or other intellectual property to Skulls Tees.
Customers requiring confidential production or restrictions on promotional use should notify Skulls Tees before production.
Quotes and Pricing
Quotes and estimates are based on the project specifications available when the quote is prepared.
Changes to garments, quantities, artwork, print locations, shipping requirements, deadlines, or other specifications may change the final price.
Quotes may include an expiration date. If no expiration date is specified, Skulls Tees may revise pricing before an order is accepted if supplier costs, availability, taxes, shipping costs, or project specifications change.
Payment
Payment requirements may vary by project.
Skulls Tees may require full payment or a deposit before ordering garments, purchasing materials, beginning production, or releasing completed goods.
Orders are not considered accepted for production until required payment and approvals have been received.
Any remaining balance must be paid according to the payment terms shown on the applicable quote, invoice, or agreement.
Taxes
Applicable sales, use, or other taxes may be added to orders as required by law.
Customers claiming tax-exempt status are responsible for providing valid documentation acceptable to Skulls Tees before the applicable transaction.
Order Changes and Cancellations
Custom orders may involve garments, transfers, supplies, artwork preparation, and other materials purchased specifically for the customer.
Once materials have been ordered or production work has begun, some or all amounts paid may become non-refundable.
Approved custom orders generally cannot be canceled after production begins.
If cancellation is permitted, the customer remains responsible for costs already incurred by Skulls Tees, including garments, materials, artwork, setup, supplier charges, shipping, and work already performed.
Custom Product Returns
Because custom products are produced specifically for the customer, custom-decorated merchandise generally cannot be returned or exchanged because of:
- Customer-approved artwork or specifications
- Incorrect sizes selected by the customer
- Change of mind
- Normal garment variations
- Minor production tolerances
- Differences between screen colors and physical print colors
If you believe an order contains a production defect or differs materially from the approved specifications, contact Skulls Tees promptly after receiving the order.
We may request photographs or other information necessary to evaluate the issue.
If Skulls Tees determines that a product contains a qualifying production error attributable to us, we may, at our discretion and as appropriate under applicable law, repair, replace, reproduce, credit, or refund the affected portion of the order.
VAULT and Non-Custom Merchandise
Products purchased from the Skulls Tees VAULT or other non-custom product offerings may be subject to separate return, exchange, or promotional terms displayed at the time of purchase.
Products made or decorated specifically after an order is placed may not qualify for the same return options as ordinary stocked merchandise.
Any product-specific return terms presented during purchase will supplement these Terms.
Production Times
Production estimates are provided in good faith but are not guarantees unless Skulls Tees specifically agrees to a guaranteed deadline in writing.
Production may be affected by garment availability, supplier delays, shipping disruptions, equipment issues, artwork changes, customer approval delays, weather, carrier disruptions, or other circumstances outside our reasonable control.
A customer’s delay in approving artwork, providing information, or making payment may affect the expected completion date.
Shipping and Delivery
Shipping and delivery dates are estimates unless otherwise expressly agreed in writing.
Once an order has been transferred to a shipping carrier, delays caused by the carrier, weather, customs, transportation disruptions, incorrect customer-provided addresses, or circumstances outside our reasonable control may affect delivery.
Customers are responsible for providing accurate shipping information.
Additional charges resulting from incorrect or incomplete customer-provided shipping information may be the customer’s responsibility.
International Orders
International shipments may be subject to customs processing, duties, taxes, import requirements, brokerage fees, or other charges imposed by the destination country or transportation providers.
Unless otherwise stated in writing, the customer or recipient is responsible for destination-country duties, taxes, customs charges, and import-related fees.
International delivery times may be affected by customs and transportation conditions outside the control of Skulls Tees.
Product Care
Customers should follow care instructions provided with their products.
Improper washing, drying, ironing, bleaching, chemical exposure, or other improper care can damage decorated apparel.
Skulls Tees is not responsible for damage resulting from care inconsistent with provided instructions or normal wear and tear.
Website Product Information
We make reasonable efforts to accurately describe products displayed on SkullsTees.com.
However, product images, garment colors, dimensions, availability, and other information may vary from actual products or may change due to supplier updates.
We reserve the right to correct errors, inaccuracies, or omissions and to update product information when necessary.
Intellectual Property
Unless otherwise indicated, SkullsTees.com and its original content, branding, graphics, designs, text, photographs, logos, and other materials are owned by or licensed to Twisted Palms Ventures, Inc. and/or Skulls Tees.
They may not be copied, reproduced, distributed, sold, modified, or commercially exploited without authorization except as permitted by law.
Third-party names, logos, trademarks, and artwork remain the property of their respective owners.
Prohibited Website Use
You may not use SkullsTees.com to:
- Engage in unlawful activity
- Attempt unauthorized access to website systems
- Introduce malicious software or code
- Interfere with website operation
- Fraudulently place orders
- Infringe intellectual-property rights
- Misrepresent your identity or authority
- Scrape or reproduce website content for unauthorized commercial purposes
Disclaimer
Except as otherwise required by applicable law, products and website services are provided on an “as available” basis.
We do not guarantee that the website will always operate without interruption or error.
Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded under applicable law.
Limitation of Liability
To the maximum extent permitted by applicable law, Twisted Palms Ventures, Inc. and Skulls Tees will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, products, or services.
To the maximum extent permitted by applicable law, our aggregate liability relating to a particular order will not exceed the amount actually paid to Skulls Tees for the portion of the order giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Twisted Palms Ventures, Inc. and Skulls Tees from third-party claims, losses, or reasonable expenses arising from customer-supplied artwork, trademarks, copyrighted materials, or other content where you lacked the necessary rights or authorization for the requested use.
Force Majeure
Skulls Tees will not be responsible for delays or failure to perform caused by circumstances reasonably outside our control, including severe weather, natural disasters, transportation disruptions, supplier interruptions, power or internet outages, governmental actions, labor disruptions, carrier delays, or similar events.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
No Waiver
Failure by Skulls Tees to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
Changes to These Terms
We may update these Terms periodically to reflect changes in our business, website, products, services, or legal requirements.
The version posted on SkullsTees.com at the time of a transaction will generally govern that transaction unless otherwise agreed in writing.
